DMCA Policy
Last updated: June 3, 2024
1. Our Commitment to Copyright Law
We take copyright infringement seriously. Spotify.Downloaderize.com is a technical conversion tool and does not host, store, or distribute any copyrighted audio content on its servers. Audio files processed through the Service are transient. They exist only for the duration of your download session and are permanently deleted immediately after.
In compliance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), we have designated a DMCA agent to receive notices of claimed copyright infringement and will respond promptly to valid notices.
2. Reporting Copyright Infringement
If you are a copyright owner, or an agent authorised to act on behalf of one, and you believe that any content accessible through or facilitated by the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent.
To be effective under the DMCA, your written notification must be sent to the contact listed in Section 7 of this page and must include all of the following elements:
3. Required Elements of a DMCA Notice
A valid DMCA takedown notice must contain:
- Physical or electronic signature: a signature (physical or electronic) of the copyright owner or a person authorised to act on their behalf.
- Identification of the copyrighted work: a description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, a representative list is sufficient.
- Identification of the infringing material: a description of the material you claim is infringing and that you request be removed, with sufficient detail to allow us to locate it (such as a URL or other specific reference).
- Your contact information: your address, telephone number, and email address so we can contact you regarding your notice.
- Good faith statement: a statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement: a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
Notices that do not comply with these requirements may not receive a response. Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and legal fees.
4. Submitting a Notice
Please send all DMCA takedown notices to our designated agent using the contact details below. Email is the preferred and fastest method:
Designated DMCA Agent
Spotify.Downloaderize.com
Email: [email protected]
Subject line: DMCA Takedown Notice: [Your Name / Organisation]
Upon receiving a valid and complete DMCA notice, we will act expeditiously to investigate the claim and, where appropriate, remove or disable access to the material identified as infringing. We will notify the user who submitted the relevant content (if applicable) that the material has been removed.
5. Counter-Notification Procedure
If you believe that material you submitted was removed as a result of a mistake or misidentification of the material, you may send a counter-notification to our designated agent. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the removed material: a description of the material that was removed and its location before removal (such as the URL where it previously appeared).
- Statement under penalty of perjury: a statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed.
- Your name, address, and telephone number.
- Consent to jurisdiction: a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or any judicial district in which we may be found, if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notification.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not notify us within 10 to 14 business days that they have filed a legal action seeking a court order to restrain the allegedly infringing activity, we may restore the removed material at our discretion.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Spotify.Downloaderize.com maintains a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our discretion, limit access to the Service for any user who infringes intellectual property rights of others, whether or not there is any repeat infringement.
7. Misrepresentation and Good Faith
Please be aware that filing a false DMCA claim is a serious legal matter. Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material or activity is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorney fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorised licensee, or by us as a service provider.
We strongly encourage you to consult with an intellectual property attorney before submitting a DMCA notice if you are unsure whether particular material infringes your copyright.
